T.I. Spawn Killing! Are these people getting banned?

I know that I've reported at least 5 people in the last week who were setting their Tactical Inserts in their enemy spawn and then "Spawn Killing". They're using their TI's just in case someone makes it out or they get killed mid-reload from timing the spawn badly.

It's been said time and time again that "Spawn Killing" aka "Killing someone instantly as they spawn, over and over again" is against ToS and it bannable.

I've send names, times, map, game type, etc to IWEnforcers on twitter, and know that these people are still playing because I have them Perma-Muted through Xbox and low and behold they pop into my lobby.

I wasn't aware it was a bannable offense. I haven't seen them mention anything about it being bannable anyway. So odds are, they probably aren't getting banned. It's cheap for sure and should be stopped (fix the spawn system), but I don't think we'll see any of them banned.

Thats not the definition of spawn killing so no they arent getting banned. Setting a TI and then killing people is not a violation.

  I'll try and find it, but I'm pretty sure I read somewhere that Spawn Killing someone instantly was a bannable offense. The fact that they're using a TI to aid in this just makes it worse...

  Spawn trapping and putting your T.I in the enemy spawn are 2 different things.

the spawn killing they mean that can get you banned is only possible in CTF with how messed up the spawns are in mw3 in all other gamemodes
only CTF has such static spawns that let you really spawnkill someone

in no other gamemode you can sit with just 3/4guys on all their spawnpoints and pick em off as they spawn
so unless you were playing CTF i doubt they will get banned
as in all other gamemodes there are so much spawnpoints and they flip so easily i doubt they were litterally spawnkilling you as would be possible in CTF, if you weren't playing CTF

  I just realized that I forgot to mention that I was playing CTF. HC CTF at that, so it doesn't take much to kill someone.
  
  They had 3-4 guys at the different spawn points SPAWN KILLING US AS WE SPAWNED.
  
  For those of you who think you know the law, the way, or ToS, or hell what was ACTUALLY taking place I could care less about your opinion on the matter(s). I know what was taking place, it's in my file share and that's that.
  
  If you're that freaking bored go under Younique Name (Xbox) and it's file share #2.

    yea that attitude will get you lots of help on these boards, maybe if you placed more info in your OP then we could have been more helpful, also there are no videos in you Elite vault.

      The videos should be uploaded. My vault has 3 highlighted so give it a shot or look wherever else it may be after I've uploaded them. I edited them to give you an idea of what was taking place throughout the whole match without uploading the whole video.
      
      After reviewing them perhaps some of you can give your opinions on what you'd call whatever it is that they're doing (What I call spawn killing).
