This was an inadvertant change that was made due to the latest website and console app updates. Our next mobile app update will allow you to accept the Terms of Service within the mobile app without having to access the website or console apps.

If you log into the Elite website and click on "My Account" in the top right, then go to "Profile," the new TOS will appear.
Not sure why it was done this way..
Anybody having this problem, confirm that this works if you try it and it does. Worked for me!

As we've updated in this thread, this is a known issue for some users which we're fixing in an upcoming update. Until this fix is implemented, please follow the below steps to accept the new Terms of Service and enable mobile app access:
1. Log into the Call of Duty ELITE website at https://elite.callofduty.com
2. Click "My Account"
3. Click "Profile"
4. Accept the Terms of Service after being prompted
5. Login into the Call of Duty ELITE mobile app
