Call of Duty^® x Hundreds Clothing Sweepstakes (“Sweepstakes”) Official Rules

No Purchase Necessary to Enter or Win. A Purchase will Not Increase Your Chances of Winning. Odds of winning depend upon the number of eligible entries received. Void in Quebec, and where prohibited.

Eligibility: The Sweepstakes is open to legal residents of the fifty (50) United States, the District of Columbia, and Canada (excluding Quebec) (“Eligible Territory”) who are eighteen (18) years of age or older (or legal age of majority, whichever is older) as of the date of entry. Employees, officers, directors, agents and representatives of Activision Publishing, Inc. (“Sponsor”), teamDigital Promotions, Inc. (“Administrator”), The Hundreds Is Huge, Inc., and each of their respective parents, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, advertising and promotion agencies (hereafter collectively, “Released Parties”), and each such individual’s immediate family members (i.e., mother, father, sister, brother, child, husband, wife and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. Void outside the Eligible Territory and where prohibited by law. All applicable federal, state and local laws apply. By participating, entrants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to this Sweepstakes.

Promotion Period: Sweepstakes begins 9:30 am Pacific Standard Time (“PST”) on September 25, 2023 and ends 11:59 pm PST on October 6, 2023 (hereafter, “Promotion Period”).

How to Enter: During the Promotion Period, follow @CallofDuty on X Corp. (hereafter referred to as “Twitter”) and post using hashtag #CODNext and #Sweepstakes (the “Hashtag”) to receive one (1) entry. 

Limit one (1) entry per person per Twitter account during the Promotion Period. Any person who attempts to participate in this Sweepstakes via multiple Twitter accounts will be ineligible. Additional entries beyond the specific limit will be void. Posts must be made by the authorized Twitter account holder at the time of entry. “Authorized account holder” is deemed as the natural person who is assigned to a Twitter address from which the entry was received. Posts must be posted by the close of the Promotion Period to be eligible to be included in the random draw. If your Twitter account is private, your Post will NOT be eligible; you must change the setting on your account from private to public or unprotected in order to submit an eligible entry. Twitter account must remain public for a duration of one (1) month following the conclusion of the Promotion Period for winner notification purposes. You must have a valid Twitter account and agree to the Twitter Terms of Service and the Twitter Privacy Policy in order to be eligible to enter via Twitter. Registration on Twitter must be completed before an entry may be submitted via Twitter. Twitter membership is free. NOTE: Sponsor may not receive entries from Twitter users with “protected” Posts (i.e., user has set their Twitter account so that only people the user has approved can view their Posts) due to the way Twitter operates its service. Posts not posted by entrants and accessible to the Sponsor during the Promotion Period will not be entered into the Sweepstakes. By including the designated Hashtag in their Post, entrants are confirming their acceptance and agreement to these Official Rules.

By entering, you consent to participate in this Sweepstakes, and you consent for Sponsor to obtain, use and transfer your first name, address and Twitter handle for the purpose of administering this Sweepstakes. Sponsor's Online Privacy Policy will apply to all personal information collected as a result of this Sweepstakes. For information regarding Sponsor's privacy policy, please visit https://www.activision.com/legal/privacy-policy. The use of script, macro or automated devices (or any other devices intended to automate or subvert any aspect of entry) to enter the Sweepstakes is prohibited and any entry through such means and any entry that is deemed to be ineligible (in accordance with these Official Rules) will be void. All entries become the exclusive property of the Sponsor and will not be acknowledged or returned. In the event of a dispute as to the identity of an entrant based on the Twitter username, entry will be awarded to the authorized account holder of the Twitter account from which said entry was submitted provided such individual is eligible according to these Official Rules.

Those participating in the Sweepstakes via mobile phone may incur standard data charges from their wireless service provider (entrants are solely responsible for any such wireless charges). To the maximum extent permitted by applicable law, Released Parties are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, damaged, inaccurate, or undelivered entries, Posts, or direct messages; or for telephonic, human or computer failures, problems or errors, defects or delays in any transmission, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, Posts, direct messages, the announcement of any prize, for any injury or damage to participant’s or any other person’s computer or other device relating to or resulting from participation in this Sweepstakes, or for printing, typographical, human or other errors appearing in these Official Rules or other Sweepstakes-related materials. Sponsor reserves the right to void any entries of entrants and disqualify such entrants who have attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes and/or who are in violation of these Official Rules.

Winner Selection: Fifty (50) potential Grand Prize winners will be selected in a random drawing conducted on or about October 7, 2023 from among all the eligible entries received by Administrator during the Promotion Period. By entering, entrants agree to be bound by these Official Rules and to the decisions of the Sponsor, which will be binding in all respects. The potential winners will be notified by Twitter direct message. Entrants must have the “Receive messages from anyone” setting enabled on their Twitter account in order to receive notifications from the Administrator. Entrants will be responsible for checking their “Message Requests”. Each potential winner must then contact Administrator using the contact information provided within forty-eight (48) hours of the notification. If any required information is not returned within the timeframe specified in the notification correspondence, or if any notification is returned as undeliverable, then the prize may be forfeited and, at Sponsor’s discretion, an alternate winner may be notified. Potential winners will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within five (5) days from the date of notification of winning. If required in the Eligible Territory, a potential winner will be required to answer correctly, without assistance of any kind (mechanical or otherwise), a time limited mathematical skill testing question which will be administered by Sponsor by telephone at a mutually agreeable time. Non-compliance with the foregoing or with these Official Rules in any way, the inability to contact a potential winner (as specified above), the inability of a potential winner to correctly answer the skill testing question as determined by Sponsor, or return of any prize or prize notification as non-deliverable may result in disqualification and, at Sponsor’s discretion, the awarding of the applicable prize to an alternate potential winner in a random drawing from among all remaining entries.

Fifty (50) Grand Prizes: Each Grand Prize winner will receive a prize pack consisting of The Hundreds merchandise including: one (1) T-shirt, one (1) pair of jogging pants, one (1) jacket, one (1) hoodie, and one (1) tote bag Approximate Retail Value (“ARV”): $500 each.  

All prize details are at Sponsor’s sole discretion. No transfer, assignment, cash redemption or substitution of any prize is permitted, except by Sponsor, which reserves the right to substitute a prize with one of comparable or greater value, as determined by Sponsor. All costs and expenses associated with the acceptance and use of a prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes are each winner’s sole responsibility. Prizes are awarded “as is” without any warranty or guarantee, either express or implied by Sponsor. ARV of all prizes awarded: $25,000.

Miscellaneous: By participating, entrants agree to be bound by these Official Rules and agree that: 1) Sponsor and its designees may use (unless prohibited by law) entrant’s name, city and state of residence, photograph, any oral or written statements, and/or likeness for advertising, trade and/or any other purposes in any media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification, and 2) the Released Parties shall have no liability and entrant will defend, indemnify and hold harmless Sponsor and the Released Parties from and against any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any prize (including, but not limited to, and travel or activity related thereto) or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Sweepstakes (or portion thereof) for any reason, including should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Sweepstakes or for any other reason and, in the case of termination, at its discretion, select the winners from all eligible non-suspect entries combined and received prior to the event that required such termination. CAUTION: Any attempt to deliberately damage the website or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek any and all remedies available from any such person(s) responsible for the attempt to the fullest extent permitted by law.

LIMITATION OF LIABILITY: IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF ANY WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES. 

Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or the prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.

Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of California, USA.
