Subscription Terms of Use

AT THE BEGINNING OF EACH SUBSCRIPTION PERIOD, YOU WILL BE AUTOMATICALLY CHARGED UNLESS YOU CANCEL OR ACTIVISION TERMINATES YOUR ACCOUNT, AS DESCRIBED IN THESE TERMS.

PLEASE READ THESE TERMS CAREFULLY. THESE TERMS INCORPORATE THE ACTIVISION EULA WHICH REQUIRES THAT YOU ARBITRATE ANY DISPUTES YOU HAVE WITH US AND YOU WAIVE THE ABILITY TO BRING CLAIMS AGAINST US IN A CLASS ACTION FORMAT.

These Subscription Terms of Use (the “Terms”), subject to the Activision Software License and Service Agreement, available HERE (the “EULA”), constitutes a legally binding agreement between you (“you”, “your”, or “user”) and Activision Publishing, Inc., (“Activision”, “we”, “us”, “our”), that governs your purchase and use of a Call of Duty Mobile Ground Forces automatically renewing subscription requiring recurring payments (each, a “Subscription”) initiated or completed on your Apple or Android mobile device (the “App”). Your purchase and use of the Subscription is also subject to Activision’s Privacy Policy, available HERE (the “Privacy Policy”). The EULA and Privacy Policy are expressly incorporated herein. If there is any conflict between the EULA or the Privacy Policy and these Terms, these Terms will control with respect to their subject matter. You may use the Subscription only in compliance with these Terms, the EULA, the Privacy Policy and all applicable laws and regulations. IF YOU DO NOT AGREE TO BE BOUND BY SUCH, YOU MAY NOT PURCHASE OR USE THE SUBSCRIPTION.

 

Subscription Period & Payment

The Subscription is offered for a monthly fee payable at the start of the relevant subscription period. Monthly subscription periods will recur each calendar month on the date of your initial purchase; provided, however that if your initial purchase occurs on a date that is not applicable in subsequent months, the monthly subscription will recur on the last calendar day of such months. By signing up for the Subscription, you agree that: (a) you will be charged your first Subscription fee and any applicable taxes on the date you purchase your Subscription; (b) you authorize us and our service providers (including the Apple App Store or Google Play Store) to store your payment method for the purpose of executing future Subscription auto-renewal transactions; (c) unless you cancel, by default (and with prior notice to the extent required by applicable law), your Subscription will automatically renew at the start of each subscription period, and (d) at the time of renewal, you will be automatically charged the then-current Subscription fee and any applicable taxes. You understand that the terms of the Apple App Store or Google Play Store apply to your App purchases, including Subscription payments.  

Activision may revise the pricing of the Subscription at any time, subject to notice to you [and we will obtain your consent before applying the revised pricing]. YOU ACKNOWLEDGE THAT ACTIVISION IS NOT REQUIRED TO REFUND AMOUNTS YOU PAY FOR USE OF THE SUBSCRIPTION, OR FOR DIGITAL PURCHASES MADE THROUGH THE SUBSCRIPTION, FOR ANY REASON, EXCEPT AS REQUIRED BY APPLICABLE LAW.

Promotional Offers

From time to time, we may offer promotional subscriptions (“Offers”). Such Offers are subject to these Terms, except as otherwise stated in the Offer. If you purchase a Subscription with a promotional code, each time your Subscription renews, you will be charged the full billing amount rather than the promotional amount. Only one promotional subscription is available per user.  Discounts and/or promotions applied at purchase of initial subscription term or advertised by us at the time of renewal are not applicable to automatic renewal purchases, unless stated otherwise. 

Cancellation & Refund Policy

You can cancel your Subscription up to 24 hours prior to the next scheduled payment to avoid further charges. For example, if the next-scheduled renewal date is January 1, you must cancel by 11:59:59 PM ET on December 31 if you wish to prevent charges for the upcoming subscription cycle. If you cancel your Subscription, you will not receive a refund or credit, but you can continue to access all Subscription benefits through the end of your then-current subscription period.

To cancel a subscription on an Apple device, you must visit your Apple App store subscription settings (Settings – Apple ID – Subscriptions) and select “Cancel Subscription,” as further described at https://support.apple.com/en-us/HT202039. To cancel a subscription on an Android device, you must visit the Google Play App’s subscription settings (Google Play – Profile – Payments & Subscriptions - Subscriptions) and select “Cancel Subscription,” as further described at https://support.google.com/googleplay/answer/7018481?hl=en&co=GENIE.Platform%3DAndroid.

Additional Terms

Your Subscription cannot be transferred or assigned. We reserve the right to refuse, suspend, or cancel your Subscription, or any part of it, for any reason at any time in its sole discretion without notice, including, without limitation, if any fraud or technical failure impairs the integrity or proper functioning of the Subscription.
